Licence, privacy and refunds

End user licence agreement

Luso RAW, version 1.0. Licensor: Pedro Lopes, Torres Novas, Portugal ("Licensor"). Please read this agreement before installing or using the Software. By installing or using the Software you agree to its terms. If you do not agree, do not install or use the Software.

1. Licence

Subject to this Agreement and payment of the applicable fee, the Licensor grants you a limited, non-exclusive, non-transferable licence to install and use the Software on the number of computers allowed by your licence key (two), for your own personal or business use. You may make one copy for archival or backup purposes, as permitted by law. You have no other right to reproduce or distribute the Software.

2. Restrictions

You may not distribute, sell, sublicense, rent, loan or lease the Software or your licence key. You may not reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software, except to the extent that applicable law expressly permits it notwithstanding this restriction.

3. Third-party software

The Software includes third-party components, including the R3D SDK redistributable libraries of RED Digital Cinema, used in unmodified form to decode supported files. If you need any other RED or Nikon software to use the Software, you must obtain it under a valid licence and use it according to the end user licence agreement that accompanies it.

4. Ownership

The Licensor and its suppliers retain all right, title and interest, including all intellectual property rights, in and to the Software. All rights not expressly granted are reserved.

5. No affiliation, trademarks

The Software is independent and is not affiliated with, endorsed, sponsored or approved by Nikon Corporation, RED Digital Cinema or Blackmagic Design. Nikon, N-RAW, RED, R3D and DaVinci Resolve are trademarks of their respective owners and are used only to describe file compatibility.

6. Your files

The Software never modifies your original clips; it writes new files. You are responsible for keeping backups of your footage and for verifying converted files before deleting any originals.

7. Disclaimer of warranty

The Software is provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by law, the Licensor and its suppliers disclaim all warranties, conditions, representations or terms, express or implied, including merchantability, satisfactory quality, fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, in no event will the Licensor or its suppliers be liable for any indirect, incidental, special or consequential damages, or for loss of data, footage, profits or business, arising out of or in connection with the Software. The Licensor's total liability shall not exceed the amount you paid for the Software. Nothing in this Agreement limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

9. Licence activation and privacy

To activate and periodically validate your licence, the Software sends your licence key and a computer name to the licence server of the store (Lemon Squeezy). No footage, file names or usage data are collected. See the privacy policy below.

10. Export

You agree to comply with all applicable export control laws, including those of the United States, and not to export or use the Software in any country or manner prohibited by them.

11. Termination

This licence ends automatically if you breach this Agreement. On termination you must stop using and delete the Software.

12. Refunds

See the refund policy below. It does not limit your statutory rights.

13. Governing law

This Agreement is governed by the laws of Portugal, without prejudice to mandatory consumer protection rules of your country of residence.

Privacy policy

This website

lusocolorlab.com uses no cookies, no analytics and no tracking. Our host keeps standard server logs (such as IP address and pages requested) for security and operation for a short period.

Purchases

Payments are processed by Lemon Squeezy, which acts as the merchant of record and handles your payment details, billing address and taxes under its own privacy policy. We receive your name, e-mail address, country and order details so we can deliver your licence and give you support.

The app

Luso RAW works entirely on your Mac. Your footage and file names are never uploaded. To activate and validate your licence, the app sends your licence key and the name of your computer to the Lemon Squeezy licence server.

Your rights

Under the GDPR you can ask to access, correct or delete the personal data we hold about you. Write to hello@lusocolorlab.com. You can also complain to the Portuguese data protection authority (CNPD).

Refund policy

Try Luso RAW free for 14 days before you buy. If you are not happy with your purchase, write to hello@lusocolorlab.com within 14 days of the purchase date with your order number, and you will get a full refund. After the refund your licence key is deactivated. This policy does not limit your statutory rights as a consumer.
